Terms & Conditions

By clicking on this box, you agree to these Terms of Use (“TOU”), which are an agreement between you and Timely Telehealth, LLC, a Texas limited liability company (“TimelyMD”) concerning your access to, and use of, the TimelyCare Peer Community (the “Micro-Site”). The TOU are in addition to, and supplemental of, the Terms and Conditions previously agreed to by you to access the Site (as such terms are therein defined), which Terms and Conditions are incorporated herein by reference. By accessing, browsing, and/or using the Micro-Site, you accept and agree to be bound by the TOU as well as the Terms and Conditions. If you do not agree to the TOU and the Terms and Conditions, do not access or use the Micro-Site. These TOU and the Terms and Conditions may change. Because your use of the Micro-Site means that you agree to the TOU and the Terms and Conditions, if we revise and update the TOU and/or the Terms and Conditions, your continued use of the Micro-Site will mean that you accept these changes. You choose whether or not to use the Micro-Site. If you do not agree to the TOU and the Terms and Conditions, please do not use the Micro-Site.

Who May Use the Micro-Site Services

These TOUs govern your use of the Micro-Site (the “Micro-Site Services”). You may use the Micro-Site Services only if you are at least 18 years old.

Your Rights and Grant of Rights in the Content

By submitting, posting or displaying content on or through the Micro-Site Services (“Content”), you grant TimelyMD a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods now known or later developed (for clarity, these rights include, for example, curating and transforming). This license authorizes TimelyMD to make your Content available to the rest of the world. You agree that this license includes the right for TimelyMD to provide, promote, and improve the Micro-Site Services and to make Content submitted to or through the Micro-Site Services available to others. Such additional uses by TimelyMD is made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Micro-Site Services as the use of the Micro-Site Services by you is hereby agreed as being sufficient compensation for the Content and grant of rights herein.

You understand that TimelyMD may modify or adapt your Content as it is distributed, syndicated, published, or broadcast by us.

You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Micro-Site Services. You agree that such Content will not contain material subject to copyright or other proprietary rights, unless you have necessary permission or are otherwise legally entitled to post the material and to grant TimelyMD the license described above.

Using the Micro-Site Services

By posting Content on the Micro-Site, you agree to be bound by, and comply with the following:

Safety

Violence: You may not threaten violence against an individual or a group of people, including, without limitation, threatening or promoting terrorism or violent extremism.
Sexual activity: You may not post any Content containing any references to sexual activity.
Abuse/harassment: You may not engage in the targeted harassment of someone, or incite other people to do so, including threats of bullying and violence, and the use of curse or offensive words.
Hateful conduct: You may not promote violence against, threaten, or harass other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease.
Personal identification details: You may not share personal details that can be used to identify yourself or others such as phone number, email address, social media link, address, or name.
Health: You may not post Content containing suicide, self-harm, severe medical conditions, eating disorders and drug use/misuse and abuse.
Sensitive media, including graphic violence and adult content: You may not post media that is excessively gory or share violent or adult content within live video or in profile or header images.
Illegal or certain regulated goods or services: You may not use the Micro-Site Service for any unlawful purpose or in furtherance of illegal activities. This includes selling, buying, or facilitating transactions in illegal goods or services, as well as certain types of regulated goods or services.

Privacy

Private information: You may not publish or post your personal information or other people’s private information, including, without limitation, your personal location, contact information and/or your college and/or university. TimelyMD also prohibits threatening to expose private information or incentivizing others to do so.
Non-consensual nudity: You may not post or share intimate photos or videos of anyone.

Authenticity

Platform manipulation and spam: You may not use the Micro-SIte in a manner intended to artificially amplify or suppress information or engage in behavior that manipulates or disrupts people’s experience using the Services and the Micro-Site Services.
Impersonation: You may not impersonate individuals, groups, or organizations in a manner that is intended to or does mislead, confuse, or deceive others.
Synthetic and manipulated media: You may not deceptively share synthetic or manipulated media that are likely to cause harm.

Third-party advertising

You may not submit, post, or display any video content on or through the Micro-Site Services that includes third-party advertising.

Amendment.

Our Micro-Site Services evolve constantly. As such, the Micro-Site Services may change from time to time, at our discretion. We also retain the right to create limits on use and storage at our sole discretion at any time. We may also remove or refuse to distribute any Content on the Micro-Site Services, limit distribution or visibility of any Content on the service, suspend or terminate users, and reclaim usernames without liability to you.

We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the TOU and the Terms and Conditions, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of TimelyMD, its users and the public. TimelyMD does not disclose personally-identifying information to third parties except in accordance with our Terms and Conditions.

Amendment of TOU. TimelyMD has the right to amend the TOU at any time without notice to you by posting the revised TOU on the Micro-Site. You agree that you are bound by those changes by continuing to use the Micro-Site.
